Did the Toronto Star defame members of the Toronto Police force in a series of articles on racial profiling? Cullity J. holds that the size of the group referred to is not the only factor in determining whether a libel has occurred. The key issue is whether an individual has been personally affected by the publication. In this case, the articles in question did not suggest that every, or any particular, officer was racist. There was no identification for purposes of defamation law, and so no defamation. |
